Humboldt County Clerk Tami Rae Spero received notice the case was being transferred from district court to federal court on Friday (April 30) afternoon.
The immediate fallout from so much happening in such a short time period has yet to be determined. The temporary stay signed on Thursday moved with the case to federal court. For everything else the participants are waiting for the court to sort out – including whether or not the temporary stay will impact pending appeals.
The Constitutional issues being addressed in Jungo v Commissioners include allegations of Fifth and Fourteenth Amendment violations of due process, equal protection under the law, and violations of Article 1 of the US Constitution protections involving interstate commerce.
