WINNEMUCCA — With the clock ticking Jungo Land & Investments received a reprieve on the expiration date of the conditional use permit (CUP) issued in 2007. It was originally thought the CUP would expire on April 12, three years to the day the Regional Planning Committee voted to approve it, but an examination of the legal fine print by the Humboldt County DA's Office has pushed the expiration date back to April 23, 2010.
Under the NRS conditional use permits go into effect five days after they're approved (five days being the appeal period) but a condition on this particular permit put the CUP into effect when the paperwork was signed on April 23. The Humboldt County DA's Office determined that --due to the legal fine print -- the CUP will remain in effect until April 23, 2010.
Jungo Land & Investments, along with its parent company Recology, have been seeking the necessary permits to develop a class 1 landfill on Jungo Rd. However, the requested five-year extension granted by the Regional Planning Committee in February was revoked last week by the Humboldt County Commissioners. The commission ruled the company did not pursue the permitting process and begin construction in a timely manner, which was a requirement of the CUP. The matter came before the commission on an appeal filed by local attorneys Robert Dolan and Massey Mayo.
